Terms of Service

Starter template — pending legal review. These Terms are a good-faith starting draft for BizRadar and have not been reviewed by an attorney. Bracketed items like the United States are placeholders the operator must complete before these Terms are published or relied upon.

1. Agreement to these Terms

These Terms of Service (“Terms”) are a binding agreement between you and BizRadar (“BizRadar,” “we,” “us,” or “our”), the operator of the BizRadar service. By signing up for, subscribing to, or using BizRadar, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the service.

2. The service

BizRadar is an information service that compiles businesses recently registered in public state business-registration records and delivers them to subscribers as a daily email digest, filtered to the counties (“turf”) the subscriber selects. An optional Approach Report feature summarizes publicly available information about a business to help you prepare outreach. BizRadar is a lead-information and productivity tool only.

3. Subscription & billing

  • Price. Paid subscriptions start at $49 per month (or as otherwise stated at signup).
  • Free trial. New subscribers may be offered a 7-day free trial. Unless you cancel before the trial ends, your subscription converts to a paid subscription and your payment method is charged.
  • Cancel anytime. You can cancel at any time. Cancellation stops future renewals; it does not automatically refund the current billing period unless required by law or stated otherwise. See our Refund Policy for details.
  • Third-party processor. Billing is handled by a third-party payment processor. By subscribing you also agree to that processor's terms. We do not store your full payment-card details.
  • Taxes & changes. Prices may exclude applicable taxes. We may change pricing prospectively; we will give reasonable notice of changes that affect your renewal.

4. Acceptable use

You agree to use BizRadar lawfully and responsibly. You will not:

  • Resell, redistribute, or scrape the lead lists or any part of the service, or use them to build a competing dataset or product.
  • Share your account or digest access with people who are not authorized users of your subscription.
  • Use the data for illegal outreach or harassment.
  • Send marketing that violates applicable anti-spam and telemarketing laws (for example CAN-SPAM, the TCPA, Do-Not-Call rules, or equivalents in your jurisdiction) when contacting leads. You are solely responsible for your own outreach and for complying with those laws.
  • Attempt to disrupt, overload, reverse-engineer, or gain unauthorized access to the service.

We may suspend or terminate access for violations of this section.

5. Lead data disclaimer

The lead data in BizRadar is compiled from publicly available state business-registration records. That underlying data is created and published by state authorities, not by BizRadar.

The service and all lead data are provided “as is” and “as available,” without warranties of any kind, express or implied. We do not guarantee the accuracy, completeness, timeliness, or fitness for any particular purpose of any lead, contact detail, or report. Records may be delayed, incomplete, outdated, or contain errors originating in the public source.

You are responsible for independently verifying any information before relying on or acting upon it.

6. Not legal or financial advice

BizRadar is an information tool. Nothing in the service, including any Approach Report or suggested outreach, constitutes legal, financial, tax, compliance, or professional advice. You should consult a qualified professional before making decisions based on the information we provide, including decisions about how you contact or market to leads.

7. Limitation of liability

To the maximum extent permitted by law, BizRadar and BizRadar will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, lost revenue, lost data, or business interruption, arising out of or related to your use of (or inability to use) the service or the lead data, even if we have been advised of the possibility of such damages.

To the maximum extent permitted by law, our total aggregate liability for any claim relating to the service is limited to the amount you paid us for the service in the twelve (12) months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

8. Termination

You may stop using BizRadar and cancel your subscription at any time. We may suspend or terminate your access if you breach these Terms, fail to pay, or use the service in a way that creates legal or security risk. On termination, your right to use the service ends; sections that by their nature should survive (such as the disclaimers and limitation of liability) will survive.

9. Governing law

These Terms are governed by the laws of the United States, without regard to its conflict-of-laws rules, and you agree that disputes will be handled in the courts located in the United States, except where applicable law requires otherwise.

10. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, for significant changes, take reasonable steps to notify subscribers. Continued use of BizRadar after an update means you accept the revised Terms.
